Frequently Asked Questions

 This Capitol Finance Program will allow Florida A&M University to participate in the federal Capitol Finance Program that will assist in addressing the infrastructure needs of the University.

Why is the legislation necessary? 

The Capital Financing Program which is funded through the US Department of Education (USDOE) is awarded to HBCUs to address infrastructure needs such as renovating classrooms, labs, and constructing and renovating housing facilities.

Why has FAMU been unable to participate?

FAMU has been unable to participate in the program due to Fl. Statute 1010.62 which prohibits state funds and contracts and grant funds to be pledged for debt. This legislation conflicts with the acceleration clause in the program application which states that in the event of a payment default, the USDOE can go after all legally available funds.

After discussions, the USDOE agreed that state funds could not be pledged. However, since the University is already subject to the federal offset clause which states that if there is a payment default; USDOE can hold other federal funds such as contracts and grants to offset the amount due. The proposed legislation aligns 1010.62 with the current federal guidelines by allowing the pledging of revenues from contracts and grants. However, no state funds will be pledged via participation in the program.

How would FAMU benefit?

FAMU's participation will allow the University to address critical housing maintenance needs via restructuring existing debt and also constructing a new facility to meet the current need resulting from an increase in demand for on-campus housing.

What would be the benefits to the state?

FAMU's participation in the program allows an external source for funding outside of state appropriations. This funding will allow FAMU to address current deferred maintenance as it relates to housing facilities and also construct a new facility which can be used for the recruiting and retaining of students.
